1. Acceptance of Terms

By downloading, installing, accessing, or using the Devotional mobile application ("App," "Devotional," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). These Terms form a legally binding agreement between you and Devotional regarding your use of the App.

If you do not agree to these Terms, please do not download, install, or use the App. Your use of the App signifies your acceptance of these Terms.

2. Eligibility

By using Devotional, you represent and warrant that:

• You are at least 13 years of age (or the age of digital consent in your country)
• You have the legal capacity to enter into a binding agreement
• You are not prohibited from using the App under applicable laws
• You will use the App in compliance with all applicable laws and regulations

3. License to Use

What You May Do:

• Save favorite devotionals for later reference
• Share devotionals with friends and family for encouragement
• Export your notes and favorites for personal use

What You May NOT Do:

• Copy, modify, or create derivative works of the App's content for commercial purposes
• Reverse engineer, decompile, or attempt to extract the source code
• Rent, lease, lend, sell, or distribute the App or its content
• Remove any proprietary notices or labels from the App
• Use the content for unauthorized commercial purposes

4. Content and Devotionals

4.1 Daily Devotionals

Devotional provides daily devotional content for spiritual encouragement. The devotionals are for personal use and are not intended as professional counseling or theological advice. You should always verify biblical content with your local church or spiritual advisor.

4.2 Content Ownership

The devotionals, Bible verses, prayers, reflections, and other content provided within Devotional are owned by Devotional or our content partners. You may not reproduce, distribute, or commercially exploit this content without explicit permission.

4.3 User-Generated Content

Your personal notes, reflections, and prayer lists are owned by you. We do not claim ownership of any content you create within the App. However, by sharing content through the App's sharing features, you grant us permission to transmit that content to your chosen recipients.

5. User Restrictions

You agree NOT to use Devotional to:

• Post, share, or transmit any offensive, abusive, or harmful content
• Harass, bully, or intimidate others (including through sharing features)
• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Upload or transmit any malicious code or viruses
• Interfere with or disrupt the App's functionality
• Use the App for any illegal or unauthorized purpose
• Impersonate any person or entity

Devotional is a place for spiritual growth and encouragement. Please use it in a way that honors God and respects others.

6. Your Data and Privacy

6.1 Local Storage

By default, all data you enter into Devotional (favorites, notes, reflections) is stored locally on your device. We do not have access to this data unless you explicitly choose to use optional cloud features.

6.2 Privacy Commitment

We respect your privacy. Your personal prayers, reflections, and devotional preferences are between you and God. We do not monitor, track, or analyze your personal content. Please review our Privacy Policy for more details.

6.3 Data Security

While we take reasonable measures to protect data transmitted to our servers, no method of transmission or electronic storage is 100% secure. You use the App at your own risk. We recommend keeping your device secure and backing up important content.

7. Donations and Payments

7.1 Free Access

Devotional is currently free to use. We believe that spiritual nourishment should be accessible to everyone regardless of financial means.

7.2 Optional Donations

If we introduce optional donations or premium features in the future:

• Donations are voluntary and help support ongoing development
• Premium features (if any) will be clearly labeled
• Core devotional content will remain free
• Payments are processed through app stores (Apple App Store or Google Play)
• All purchases are subject to app store terms and conditions

8. Refund Policy

Since Devotional is currently free, refunds are not applicable. If we introduce paid features in the future:

• Refund requests will be handled by the respective app stores
• We generally do not offer direct refunds
• If you experience technical issues, please contact our support team for assistance
• We strive to resolve any issues fairly and promptly

9. Termination

We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination:

• Your right to use the App will immediately cease
• You may uninstall the App at any time
• Data stored locally on your device will remain unless you delete it
• You will not be entitled to any refunds (if applicable)

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• The content is completely free from errors or omissions
• The App is free from viruses or other harmful components
• Any specific results will be achieved through using the App

The devotional content is for spiritual encouragement purposes only and does not constitute professional counseling or theological advice.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Devotional AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID TO US IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Devotional and its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your content or conduct

13. Third-Party Services

Devotional may integrate with third-party services (such as app stores, analytics providers, or cloud storage). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third parties.

Currently, Devotional integrates with:

• Apple App Store and Google Play Store for distribution
• Anonymous crash reporting services (no personal data)

14. Changes to Terms

We may update these Terms from time to time to reflect changes in our practices or legal requirements. We will notify you of significant changes by:

• Posting the new Terms on this page
• Updating the "Last Updated" date
• Displaying an in-app notification for major changes

Your continued use of the App after such changes constitutes acceptance of the new Terms. If you do not agree to the updated Terms, please discontinue using the App.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation, and if unresolved, shall be resolved exclusively in the courts located in Delaware.

We believe in resolving disputes amicably and in a Christ-like manner, following Matthew 18:15-17 principles when possible.
